M\u00e4rz des \u00fcber\u00adn\u00e4chs\u00adten Jah\u00adres:<\/p>\n<p class=\"serif\">Bun\u00addes\u00adar\u00adbeits\u00adge\u00adricht, Ur\u00adteil vom 07.08.2012, 9 AZR 353\/10<\/p>\n<div class=\"copy\">\n<div class=\"bildunterschrift\">Bei lan\u00adger Krank\u00adheit gibt es kein end\u00adlo\u00adses An\u00adsam\u00admeln von Ur\u00adlaub mehr.<\/div>\n<p>Im All\u00adge\u00admei\u00adnen ver\u00adf\u00e4llt der ge\u00adsetz\u00adli\u00adche <a href=\"http:\/\/www.hensche.de\/Rechtsanwalt_Arbeitsrecht_Handbuch_Urlaub.html\"><span style=\"color: #4b6186;\">Ur\u00adlaub<\/span><\/a> er\u00adsatz\u00adlos, wenn er nicht bis zum Jah\u00adres\u00aden\u00adde ge\u00adnom\u00admen wird. Das gilt aber nach der Recht\u00adspre\u00adchung des Eu\u00adro\u00adp\u00e4i\u00adschen Ge\u00adrichts\u00adhofs (EuGH) und des Bun\u00addes\u00adar\u00adbeits\u00adge\u00adrichts (BAG) nicht f\u00fcr den <a href=\"http:\/\/www.hensche.de\/Rechtsanwalt_Arbeitsrecht_Handbuch_Urlaub.html\"><span style=\"color: #4b6186;\">Ur\u00adlaub<\/span><\/a>, den Ar\u00adbeit\u00adneh\u00admer we\u00adgen ei\u00adner <a href=\"http:\/\/www.hensche.de\/Urlaub_Krankheit_Arbeitsrecht_Urlaub_Krankheit.html\"><span style=\"color: #4b6186;\">Er\u00adkran\u00adkung<\/span><\/a> nicht neh\u00admen konn\u00adten.<\/p>\n<p>Al\u00adler\u00addings darf das \u201eAn\u00adspa\u00adren\u201c von Ur\u00adlaubs\u00adan\u00adspr\u00fc\u00adchen bei lan\u00adger Er\u00adkran\u00adkung zeit\u00adlich be\u00adgrenzt wer\u00adden. Das ent\u00adschied der EuGH En\u00adde 2011 in ei\u00adnem Fall, in dem es um ei\u00adne ta\u00adrif\u00adver\u00adtrag\u00adli\u00adche Ver\u00adfalls\u00adfrist von 15 Mo\u00adna\u00adten (ge\u00adrech\u00adnet ab dem En\u00adde des Ur\u00adlaubs\u00adjah\u00adres) ging. Ei\u00adne sol\u00adche zeit\u00adli\u00adche Be\u00adgren\u00adzung des Ur\u00adlaubs\u00adschut\u00adzes in Krank\u00adheits\u00adf\u00e4l\u00adlen hielt der EuGH f\u00fcr eu\u00adro\u00adpa\u00adrecht\u00adlich zu\u00adl\u00e4s\u00adsig (<span style=\"color: #4b6186;\">EuGH, Ur\u00adteil vom 22.11.2011, C-214\/10 &#8211; KHS gg. Schul\u00adte<\/span>).<\/p>\n<p>Wie die\u00adse eu\u00adro\u00adpa\u00adrecht\u00adli\u00adche Be\u00adgren\u00adzung des Schut\u00adzes er\u00adkrank\u00adter Ar\u00adbeit\u00adneh\u00admer in Deutsch\u00adland um\u00adge\u00adsetzt wer\u00adden k\u00f6nn\u00adte, ist seit die\u00adsem Ur\u00adteil um\u00adstrit\u00adten. Denn das <a href=\"http:\/\/www.hensche.de\/Rechtsanwalt_Arbeitsrecht_Gesetze_BUrlG.html\"><span style=\"color: #4b6186;\">Bun\u00addes\u00adur\u00adlaubs\u00adge\u00adsetz (BUrlG)<\/span><\/a> ent\u00adh\u00e4lt ei\u00adne sol\u00adche Spe\u00adziel\u00adre\u00adge\u00adlung f\u00fcr Krank\u00adheits\u00adf\u00e4l\u00adle nicht. Trotz\u00addem hat das Bun\u00addes\u00adar\u00adbeits\u00adge\u00adricht (BAG) in ei\u00adnem Grund\u00adsatz\u00adur\u00adteil vom heu\u00adti\u00adgen Ta\u00adge zu\u00adguns\u00adten der Ar\u00adbeit\u00adge\u00adber\u00adsei\u00adte ent\u00adschie\u00adden, dass der in Krank\u00adheits\u00adf\u00e4l\u00adlen &#8220;an\u00adge\u00adspar\u00adte&#8221; Ur\u00adlaub all\u00adge\u00admein, d.h. auch oh\u00adne ei\u00adne ta\u00adrif\u00adver\u00adtrag\u00adli\u00adche Re\u00adge\u00adlung, 15 Mo\u00adna\u00adte nach dem En\u00adde des Ur\u00adlaubs\u00adjah\u00adres ver\u00adf\u00e4llt, d.h. zum 31.
